P.E.S.T. NEEDS HELP GATHERING SIGNATURES Letter from P.E.S.T.Committee to Prevent Employers from Seizing Tips September 24, 2008 Fellow Tip Earners: As you know, we are working to change Nevada statute to prohibit employers from confiscating worker’s tips. We are in the process of organizing volunteers to collect petition signatures so that we can compel the legislature to change NRS 608-160 to protect our tips. We have a great opportunity during this election cycle to have our people at all the early voting sites throughout the valley and gain the support of thousands of registered voters. We need over 58,000 signatures so you can see we must get to work. Remember, the only way we can protect our tips is to change the law. And since every other path we tried was blocked by the “special interests,” the initiative petition is the only legal way left to us. Early voting will take place from October 18th through October 31st. We need all the volunteers we can get. We are setting up the schedules now and we need to know how many people will help us collect signatures. Please send your name, telephone number and email address to us at dealers@iuge.net, or just telephone us. From now until the early voting effort kicks in you can collect signatures on your own. Simply download the petition forms and collect signatures at any governmental location such as the DMV, public libraries, or any Federal, State, County or City location. You can set your own schedule. All you need is a clipboard and some moxie. After you fill the forms with signatures, please get them notarized and mail them to: PEST Committee If you cannot get hold of a notary, call us and we will meet you and take care of that for you. We have a lot of tip earners in this town and if everyone pulls together it will not be that hard to get the 58,000+ signatures we need to get this on the ballot. This is our last shot to correct an injustice. The P.E.S.T. Committee ------------------- FACE TO FACE: THE ONLY OPTION NEVADA SUPREME COURT HEARING : On April 7, 2008, the seven member court heard our case. We are still awaiting the outcome. LABOR COMMISSIONER HEARING: Originally scheduled March 19, 2008, the hearing has been granted a continuance until the Supreme Court ruling. Click here for the TWU form letter. A complaint was filed six months ago regarding the 'illegality' of the new tip pooling policy at Wynn Las Vegas. The Labor Commissioner said: "The issues presented in the claim present a significant public policy question that needs to be resolved." The case will go to a hearing at the Labor Commissioner's Office on March 19 at 9 a.m. We, the tip earners of Nevada, should be happy to have these issues officially being heard in the proper venue. No matter where you work in Nevada as a tip earner, this hearing concerns you. If Wynn Las Vegas can take the tips from an employee without permission or an agreement and give them to other employees/managers, then any employer in the State of Nevada can do the same.
